The Advertising Standards Authority (ASA) has upheld a complaint against Phoenix Dance for using the images of two naked dancers in its season brochure.

The complainant, who had seen the performance, objected that the leaflet was misleading because the image did not resemble the actual performance. The complaint was upheld because the ASA noted that one of the images appeared next to a list of performance times and dates, and another next to reviewers? comments. Because of that, it considered that readers were likely to expect performances to contain nudity. Phoenix Dance has been asked in future to ensure that, if similar images are used for its leaflets again, they make it clear that performances are fully clothed.
